Right of Use
Unless otherwise agreed, the purpose-bound right of use after payment without time limitation lies with the customer. Only the customer is entitled to use the photographic work within the framework of the agreement made with the photographer. Without mutual written agreement, the customer is not entitled to transfer the right to use the photographic work to third parties.
For business shots, the purpose-bound right of use of the images is included unless otherwise agreed.
Examples of use: Business portraits, team photos, company event photos, and corporate images may be used for use in the annual report, on your own website, on your own social media channels, and blog posts, as well as for the design of your own printed products such as flyers or business cards.
Use of photographic works by the photographer
Unless expressly agreed otherwise, the photographer may mention the customer's name as a reference and publish reference images for self-promotion both as print media and online.
Extended purpose of use
If the duration, nature, and scope of use are on a larger scale, the photographer as the author is entitled to charge appropriate remuneration (buyouts) for the use of his works.
Third-party rights
The customer is responsible for ensuring that he has the necessary copyright, trademark, and other rights to the images, etc., submitted by him. If third parties assert claims against the photographer in connection with an order due to infringement of copyright, trademark, or other rights, the customer is obliged to defend these claims at his own expense and to compensate the photographer for any damages incurred.
Payment terms
Invoices are payable within 15 days from the invoice date.
Photographer's liability
The photographer is liable, including liability for defects, only for intentional and grossly negligent behavior. If the client has not given the photographer any explicit instructions regarding the design or technical nature of the images, complaints regarding the interpretation of the images as well as the artistic and technical design are excluded. The customer must make his complaint regarding defects within five working days from the delivery date of the work in writing, otherwise, the photographic work is deemed to have been approved and no claims can be made.
Jurisdiction and applicable law
Exclusive place of jurisdiction and place of performance is the registered office of the photographer, even for deliveries abroad. Swiss law shall exclusively apply to all contractual relationships between the customer and the photographer.
